1 Introduction
These Terms & Conditions ("Terms") govern the use of vehicle hire services and the car enrollment program offered by Fauzz Corporate Car Rentals ("Fauzz", "we", "us", or "our"), based in Nairobi, Kenya. By booking a vehicle, enrolling a car, or otherwise using our services, you ("Customer", "Car Owner", or "you") agree to be bound by these Terms.
2 Eligibility & Driver Requirements
- Customers must be at least 23 years old and hold a valid driving licence, recognised in Kenya, for self-drive hire.
- A valid national ID or passport is required at the time of booking confirmation and vehicle handover.
- Fauzz reserves the right to decline a booking where eligibility or licence requirements are not met.
3 Booking & Reservations
Bookings may be made through our website, WhatsApp, or by phone. A booking is only confirmed once Fauzz has acknowledged it and, where required, a deposit has been received. Fauzz reserves the right to substitute a similar vehicle of equal or higher category where the originally requested vehicle becomes unavailable.
4 Payment Terms
- Payments are accepted via M-Pesa, bank transfer, or card.
- A deposit is required to confirm most bookings, with the balance due before or at vehicle handover unless otherwise agreed in writing.
- Corporate accounts with monthly invoicing are available on request, subject to approval.
5 Cancellations & Refunds
- Cancellations made at least 48 hours before the scheduled pickup time are eligible for a full refund of any deposit paid.
- Cancellations made within 48 hours of pickup, or no-shows, may forfeit the deposit to cover preparation and lost-booking costs.
- Refunds, where applicable, are processed within 5–7 working days to the original payment method.
6 Vehicle Use & Conduct
- Vehicles must only be driven by the customer named on the booking, or an additional driver formally registered with Fauzz.
- Vehicles may not be used for any illegal purpose, sub-let, used for racing, off-road driving (unless specifically agreed), or driven outside Kenya without prior written approval.
- Smoking inside vehicles is not permitted. A cleaning fee applies where this condition is breached.
7 Fuel Policy
Vehicles are issued with a documented fuel level and must be returned at the same level. Vehicles returned with less fuel will be refuelled by Fauzz and the cost, plus a service fee, charged to the customer.
8 Mileage & Geographic Limits
Standard hires include a fair-use daily mileage allowance. Trips outside Nairobi, or beyond 50 km from our base, may attract an additional per-kilometre charge, communicated at the time of booking.
9 Insurance, Damage & Liability
- All vehicles are covered by comprehensive insurance, subject to the policy's standard terms and excess.
- The customer is liable for any insurance excess, traffic fines, tolls, or penalties incurred during the hire period.
- Any accident, theft, or damage must be reported to Fauzz and, where applicable, the police, immediately.
- Fauzz is not liable for personal belongings left in or lost from the vehicle during the hire period.
10 Late Returns
Vehicles must be returned by the agreed date and time. Late returns are charged at a pro-rated daily rate for each additional period, unless an extension has been agreed in advance.
11 Car Enrollment Terms (For Vehicle Owners)
- Vehicles submitted for enrollment are subject to an inspection and approval process before being added to the active fleet.
- Approved vehicles earn a fixed monthly income as agreed in the individual enrollment agreement, payable on the schedule set out in that agreement.
- Fauzz manages all bookings, day-to-day operations, and customer relationships for enrolled vehicles.
- Either party may terminate an enrollment agreement subject to the notice period set out in that agreement.
12 Limitation of Liability
To the fullest extent permitted by Kenyan law, Fauzz's liability for any claim arising from these Terms is limited to the value of the relevant booking or enrollment payment. Fauzz is not liable for indirect, incidental, or consequential losses.
13 Governing Law
These Terms are governed by the laws of the Republic of Kenya, and any disputes arising from them shall be subject to the jurisdiction of the courts of Kenya.
14 Changes to These Terms
Fauzz may update these Terms from time to time. Continued use of our services after an update constitutes acceptance of the revised Terms. The "Last updated" date at the top of this page reflects the most recent revision.
